1. Who we are and how these Terms apply
These Terms of Service ("Terms") govern your use of the website at ecomlaunchco.com (the "Site") and describe the standard terms on which eCom Launch Co. ("eCom Launch Co.", "we", "us", or "our"), an independent e-commerce agency based in Seattle, Washington, provides its services. By using the Site, requesting an appointment, or engaging us for services, you agree to these Terms.
Paid engagements are governed by a written proposal or statement of work ("SOW") and our Master Services Agreement ("MSA"). If these Terms conflict with a signed MSA or SOW, the MSA or SOW controls for that engagement. Descriptions of services and tiers on the Site are summaries only; the specific scope, deliverables, and price of any engagement are those set out in your SOW.
2. Our services
We offer two separate services:
Shopify Website Build & Launch — design, technical infrastructure, and retention setup for a new Shopify store, delivered in three tiers (Starter Build, Growth Build, Premier Build). This service does not include advertising, media buying, or ad management.
Growth Marketing Services — ongoing paid-media management, creative production, and performance reporting, delivered in three tiers (Starter Growth, Scale Growth, Premier Enterprise). Growth Marketing is offered only for stores that eCom Launch Co. has built. We do not manage advertising for stores we did not build.
We may update, add, or discontinue tiers or features at any time. Changes do not affect engagements already agreed in a signed SOW.
3. What we don't build, and what you promise about your products
We are selective about the products we build stores for. We will not build, launch, or market a store that sells:
food, beverages, dietary supplements, or anything intended to be ingested, applied to the body as a consumable, or otherwise regulated as a food, drug, or cosmetic;
weapons of any kind, including knives, firearms, ammunition, and accessories, or other safety-critical goods;
subscription or recurring-billing products;
digital products or downloads;
counterfeit, replica, "lookalike," or unlicensed branded or licensed merchandise, or any product that infringes a third party's intellectual property.
We may decline, pause, or terminate any engagement, at any stage, if we determine in our reasonable judgment that the products, business model, or marketing practices involved fall into a restricted category, are unlawful, are prohibited by Shopify, Meta, TikTok, Google, Klaviyo, or a payment processor, or create unacceptable legal or reputational risk. We may also advise against, and are not obliged to build for, products that are fragile, oversized, sizing-dependent, or otherwise likely to produce high breakage, shipping cost, or return rates.
By engaging us you represent and warrant that: (a) you have the legal right to sell every product on your store; (b) your products, claims, labels, and marketing comply with all applicable laws, including consumer-protection, advertising, product-safety, customs, and tax laws; (c) you hold or have licensed all trademarks, images, and content you provide to us; and (d) you will keep those representations true for as long as the store operates.
4. Your responsibilities
You are responsible for:
providing product information, imagery, brand assets, copy, and feedback in a timely manner; delays in your input extend our timelines;
opening and holding all platform accounts — including Shopify, Klaviyo, domain registration, payment processing, and advertising accounts — in your own name, and paying all platform fees, app subscriptions, transaction fees, and advertising spend directly to those providers;
the accuracy and legality of all claims made on your store and in your advertising, including pricing, shipping times, product descriptions, and any health, safety, or performance claims;
your supplier and fulfillment relationships, product quality, shipping, returns, refunds, and customer service to your customers;
collecting and remitting sales tax, complying with privacy laws applicable to your customers, and publishing your own store policies;
maintaining the security of your accounts and passwords after handover.
5. Appointments, onboarding, and account management
Submitting the appointment form on the Site is a request only; it does not create a contract or reserve services. We aim to respond within two business days but do not guarantee a response time. Engagements begin with an onboarding appointment, after which we issue a written proposal or SOW. Ongoing engagements include account-management check-ins at the cadence stated in your SOW. If you miss a scheduled appointment without notice, we may require rescheduling before work continues.
6. Fees, payment, and refunds
Fees are stated in your SOW. Unless the SOW says otherwise: Website Build engagements require a deposit before work begins, with the balance due before final handover; Growth Marketing tiers are billed monthly in advance. Invoices are due on receipt. We may pause work on overdue accounts and charge interest on late amounts at 1% per month (or the maximum permitted by law, if lower) plus reasonable collection costs.
Fees do not include third-party costs such as Shopify plans, apps, themes, domains, Klaviyo or other software subscriptions, stock media, or advertising spend, all of which you pay directly. Because our work is custom and begins promptly, deposits and fees for phases already started are non-refundable except as required by law or expressly stated in your SOW. Prepaid Growth Marketing fees for months not yet started are refundable on termination in accordance with Section 17.
7. Timelines
Timelines we provide are good-faith estimates. They depend on your timely delivery of content, feedback, and account access, and on third-party platforms. We are not liable for delays caused by you, by third parties, or by events beyond our reasonable control.
8. Deliverables, revisions, and acceptance
Each tier includes the number of design revision rounds stated in your SOW. Requests outside the agreed scope are handled as change orders at our then-current rates. Deliverables are deemed accepted when you approve them in writing or when you use them in production, or seven (7) days after we present them for review if you have not provided specific written objections, whichever comes first.
9. Ownership and handover
On completion of the engagement and receipt of all amounts due, we transfer full administrative access to and ownership of the store, theme, and configured accounts to you, to the extent those accounts are not already in your name. Until then we may retain access necessary to perform the work. We retain ownership of our pre-existing tools, code libraries, templates, processes, and know-how, and grant you a perpetual, non-exclusive license to use any of them incorporated into your deliverables as part of your store. We may reference your store and non-confidential results in our portfolio unless you opt out in writing.
10. Post-launch support
The Premier Build tier includes thirty (30) days of post-launch technical support, beginning on the launch date, covering defects in work we delivered. Other tiers include only the support stated in the SOW. Support does not cover new features, changes to third-party platforms, apps, or APIs, issues caused by changes you or third parties make, or ongoing maintenance. Additional support is available under a separate agreement.
11. Growth Marketing services
Growth Marketing tiers cover management, creative production, and reporting only. You own your advertising accounts and pay all advertising spend directly to Meta, TikTok, Google, or other platforms; we never hold or advance ad budget. Creative assets are produced from footage, images, and brand assets you provide, and you are responsible for having the rights to them and for the truthfulness of any claims in them. Advertising platforms may reject, pause, restrict, or ban accounts or ads at their discretion; we will work in good faith to address platform issues but do not guarantee approvals, account standing, delivery, reach, cost, ROAS, CPA, or any other metric. Reporting and testing follow the cadence stated for your tier. Either party may end an ongoing Growth Marketing engagement on thirty (30) days' written notice.
12. No guarantees
Building a store and running advertising involve business risk. We do not guarantee, and nothing on the Site or in our communications should be read as a guarantee of, sales, revenue, profit, return on ad spend, conversion rate, traffic, search rankings, platform approvals, or any other business outcome. Results depend on factors we do not control, including your products, pricing, margins, suppliers, market conditions, competition, advertising budget, and the policies of third-party platforms. Any examples, projections, or benchmarks we discuss are illustrative only. Please also read our Earnings Disclaimer.
Except as expressly stated in a signed SOW, our services and deliverables are provided "as is," and we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
13. Limitation of liability
To the fullest extent permitted by applicable law: (a) eCom Launch Co. will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost sales, lost data, business interruption, loss of goodwill, or the cost of substitute services, arising out of or relating to the Site, our services, or these Terms, however caused and under any theory of liability, even if we were advised of the possibility of such damages; and (b) our total cumulative liability for all claims arising out of or relating to the Site, our services, or these Terms will not exceed the fees you actually paid to us for the specific engagement giving rise to the claim during the three (3) months before the event giving rise to the claim, or one hundred U.S. dollars ($100) if you have paid no fees.
Without limiting the above, we are not liable for: the acts or omissions of Shopify, Klaviyo, Meta, TikTok, Google, payment processors, suppliers, or any other third party; payment holds, chargebacks, account restrictions, or bans imposed by third parties; your products, claims, or business decisions; or any loss resulting from information or access you provide to us being inaccurate or unauthorized.
Some laws do not allow certain limitations of liability. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for our gross negligence, willful misconduct, or fraud. In those cases our liability is limited to the greatest extent the law allows.
14. Indemnification
You will defend, indemnify, and hold harmless eCom Launch Co. and its owners, employees, and contractors from and against any claims, losses, damages, liabilities, penalties, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: your products and their sale, safety, labeling, or marketing; content, assets, or instructions you provide; your breach of these Terms, your SOW, or applicable law; your violation of any third-party right, including intellectual property; your advertising claims; or any dispute between you and your customers, suppliers, or platforms.
15. Third-party platforms and trademarks
Our services depend on third-party platforms whose terms, pricing, features, and policies change without notice and are outside our control. You agree to comply with the terms of each platform you use. Shopify, Klaviyo, Meta, TikTok, Google, and other names are trademarks of their respective owners; we are an independent company and our use of those names describes compatibility only and does not imply endorsement, certification, or partnership.
16. Confidentiality
Each party will keep the other's non-public business information confidential and use it only for the engagement, except as required by law. This obligation survives for two (2) years after the engagement ends, or indefinitely for trade secrets.
17. Termination
Either party may terminate an engagement for material breach if the breach is not cured within fifteen (15) days of written notice. We may terminate immediately under Section 3. Ongoing Growth Marketing engagements may be ended by either party on thirty (30) days' written notice. On termination you will pay for all work performed and expenses incurred through the termination date; deliverables paid for in full will be handed over under Section 9. Sections 3, 6, 9, 12, 13, 14, 15, 18, and 19 survive termination.
18. Governing law and disputes
These Terms and any dispute arising out of or relating to them, the Site, or our services are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. Before filing any claim, the parties will attempt in good faith to resolve the dispute through direct negotiation for at least thirty (30) days after written notice. Any claim not resolved will be brought exclusively in the state or federal courts located in King County, Washington, and each party consents to the personal jurisdiction of those courts. Each party waives any right to a jury trial to the extent permitted by law. Any claim must be brought within one (1) year after it arises, or it is permanently barred, except where the law does not permit that limitation. The prevailing party in any action to enforce these Terms may recover its reasonable attorneys' fees and costs.
19. General
These Terms, together with any MSA and SOW, are the entire agreement between you and us about their subject matter. If any provision is unenforceable, the rest remain in effect and the unenforceable provision will be modified to the minimum extent necessary. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them to a successor. We are an independent contractor, not your employee, partner, or agent. We may update these Terms by posting a revised version with a new "Last updated" date; changes apply to use of the Site after posting and to new engagements.

1. Scope
This Privacy Policy explains how eCom Launch Co. ("we", "us") collects, uses, and shares personal information when you visit ecomlaunchco.com (the "Site"), request an appointment, or communicate with us. It does not cover the stores we build for clients; each client is responsible for the privacy practices and policies of their own store.
2. Information we collect
Information you give us
When you submit the appointment form we collect the service and tier you select, your name, your email address, and your consent to be contacted. If you email or call us, we collect whatever you choose to share. We do not ask for or intentionally collect payment card numbers, government identifiers, or health information through the Site.
Information collected automatically
Our hosting provider, Cloudflare, automatically processes technical data needed to serve and protect the Site, such as your IP address, approximate country, browser type, the pages requested, and timestamps. When you submit the form we record the country associated with your IP address and the time of submission to help detect spam. If bot protection (Cloudflare Turnstile) is enabled, it may collect device and browser signals to distinguish people from bots.
3. How we use information
We use information to respond to your request and schedule appointments; to provide, scope, and deliver services you engage us for; to communicate with you about your inquiry or engagement; to detect and prevent spam, abuse, and security threats; to comply with legal obligations; and to keep records of our business. We do not sell personal information and we do not use it for third-party targeted advertising.
4. Who we share information with
We share information only with service providers that help us run the Site and our business, and only for the purposes above:
Cloudflare — hosts the Site, runs the form endpoint, provides security, and (if enabled) bot protection.
Resend — delivers form submissions to our inbox by email.
Slack or Discord — if enabled, receives an internal notification containing the name, email, service, and tier from a submission.
Google Fonts — serves the typeface used on the Site; your browser requests the font files from Google.
Unsplash and Pexels — host the photography and video shown on the Site; your browser requests those files from their servers.
We may also disclose information if required by law, to protect our rights or safety or those of others, or as part of a merger, acquisition, or sale of our business. We do not share your information with other clients.
5. Cookies and similar technologies
The Site itself does not set advertising or analytics cookies. Cloudflare may set strictly necessary cookies for security and bot protection (for example, when Turnstile is enabled). You can control cookies through your browser settings; blocking necessary cookies may prevent the form from working.
6. How long we keep information
Appointment requests and related correspondence are kept for as long as needed to respond to you and, if you become a client, for the duration of the engagement plus the period required for our business, tax, and legal records (generally up to seven years). Technical logs held by Cloudflare are retained according to Cloudflare's policies. You may ask us to delete your information at any time (see Section 8).
7. Security
We use reasonable administrative and technical safeguards, including HTTPS encryption, strict security headers, validation and rate limiting on the form, and encrypted storage of service credentials. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
8. Your choices and rights
You can ask us to access, correct, or delete the personal information we hold about you, or to stop contacting you, by emailing support@sitehelpgroup.com. We will verify your request and respond within a reasonable time, and within any period required by law. Depending on where you live you may have additional rights under laws such as the California Consumer Privacy Act; we honor those rights to the extent they apply. Washington residents: we do not collect consumer health data as defined in Washington's My Health My Data Act through the Site.
9. Children
The Site is intended for business owners and is not directed to anyone under 18. We do not knowingly collect personal information from minors. If you believe a minor has provided us information, contact us and we will delete it.
10. Links to other sites
The Site links to third-party websites and platforms. Their privacy practices are their own; please review their policies.
11. Changes to this policy
We may update this policy from time to time. The "Last updated" date at the top shows the current version. Material changes will be posted on this page.

1. No guarantees of any kind
eCom Launch Co. builds Shopify stores and, for stores we have built, manages growth marketing. We do not — and cannot — guarantee that you will make any money, or any particular amount of money, from a store we build or campaigns we manage. Nothing on our website, in our proposals, in our tiers and deliverables, in our communications, or in any material we produce is a promise, guarantee, projection, or prediction of sales, revenue, profit, return on ad spend (ROAS), cost per acquisition (CPA), conversion rate, traffic, rankings, growth, or any other financial or business result.
2. Results depend on you and on factors we don't control
Whether an online store succeeds depends overwhelmingly on things outside our control, including but not limited to: your products, their quality, pricing, and margins; your suppliers and fulfillment; your brand and content; your advertising budget and how it is spent; your customer service, returns, and refunds; market demand, seasonality, and competition; changes to platform policies, algorithms, and costs; economic conditions; and your own decisions, effort, and follow-through. Many new online stores do not become profitable. You should be prepared to lose some or all of what you invest, including our fees, platform fees, inventory, and advertising spend.
3. Advertising spend is at your own risk
If you use our Growth Marketing services, you fund advertising spend directly with Meta, TikTok, Google, or other platforms, from accounts in your name. That spend is yours and is at your sole risk. Advertising may produce no sales, produce sales at a loss, or produce results that later reverse (for example through refunds or chargebacks). We do not refund, reimburse, credit, or otherwise make good any advertising spend, regardless of results.
4. Examples, projections, and benchmarks
Any numbers, ranges, examples, case studies, benchmarks, or scenarios we discuss — whether about our clients, the industry, or hypothetical stores — are illustrative only. They are not typical, are not a promise of what you will achieve, and should not be relied on in making any decision. Where we do quote a figure, we make no representation that it is accurate, current, or achievable in your situation.
5. Not professional advice
We provide design, engineering, configuration, creative, and marketing-management services. We are not accountants, attorneys, tax advisers, financial advisers, or investment advisers, and nothing we say or produce is legal, tax, financial, or investment advice. Decisions about whether to start a business, what to sell, how much to invest, and how to structure or operate your company are yours alone, and you should consult qualified professionals before making them.
6. Third-party platforms
Shopify, Klaviyo, Meta, TikTok, Google, payment processors, and other providers can change their terms, features, pricing, and policies, and can restrict, hold, reject, suspend, or terminate accounts, ads, and payouts at any time and for reasons we cannot predict or control. We are not responsible for any such action or for any loss it causes, and we do not guarantee approvals, account standing, ad delivery, or payout timing.
7. Your assumption of risk and release
By using our website or engaging our services you acknowledge that you have read and understood this Disclaimer and our Terms of Service, that you are relying on your own judgment and not on any statement of ours about results, and that you assume all risk associated with starting, operating, and marketing an online store. To the fullest extent permitted by law, you release eCom Launch Co. and its owners, employees, and contractors from any and all claims, demands, losses, and damages of every kind relating to the financial or business results of a store we build or campaigns we manage.
8. Limitation of liability
To the fullest extent permitted by applicable law, eCom Launch Co. is not liable for any loss of sales, revenue, profit, savings, data, goodwill, or business opportunity, for the cost of advertising spend or inventory, for chargebacks, payment holds, or account actions imposed by third parties, or for any indirect, incidental, special, consequential, exemplary, or punitive damages, arising out of or relating to our services or to your reliance on anything we have said or produced, however caused and under any theory of liability. Our total liability for all claims of any kind is limited as set out in Section 13 of our Terms of Service.
Where the law limits limitations. Some jurisdictions, including Washington, do not permit a business to exclude all liability — for example liability for its own gross negligence, willful misconduct, or fraud, or liability arising under consumer-protection laws. Nothing in this Disclaimer excludes or limits any liability that cannot lawfully be excluded or limited. In those cases our liability is limited to the greatest extent the law allows.
9. Relationship to our Terms
This Disclaimer is part of and should be read together with our Terms of Service, which contain additional disclaimers, limitations of liability, and your indemnification obligations. If this Disclaimer conflicts with a signed Master Services Agreement or statement of work, that agreement controls for the engagement it covers.
Email is the best channel for anything technical, because it lets us look at your store before we reply. Include your store name or URL, a short description of what you expected to happen and what happened instead, and screenshots or a screen recording if you have them. We aim to reply to client support requests within one business day, Monday to Friday, Pacific time; complex issues may take longer to resolve, and we'll keep you posted along the way.
What post-launch support covers
If your tier includes post-launch technical support (thirty days for Premier Build, or as stated in your proposal), it covers defects in the work we delivered — for example a template that doesn't render correctly, a tracking event that doesn't fire, or an automation we configured that isn't sending. It does not cover new features or design changes, edits to products or content, changes made by you or by third-party apps and platforms after launch, or issues with Shopify, Klaviyo, ad platforms, or suppliers themselves. If something falls outside support, we'll tell you and quote it separately.
Common questions
I can't log in to my Shopify admin.+
Your Shopify account is in your name, so password resets go through Shopify directly: on the login screen choose Forgot password. If you've lost access to the email on the account, contact Shopify Support — we don't hold your password and can't reset it for you.
Something on my store looks broken.+
Email support with the page URL, the device and browser you're on, and a screenshot. If you recently installed an app or changed a theme setting, mention that too — it's the most common cause.
My tracking or emails stopped working.+
Platforms occasionally change or disconnect integrations. Send us what stopped and roughly when you noticed, and we'll check whether it's inside your support window.
Can you make changes or add features after launch?+
Yes — as a separate, quoted piece of work. Send us what you have in mind and we'll reply with scope and timing.
How do I cancel or pause Growth Marketing?+
Email support@sitehelpgroup.com. Ongoing engagements can be ended by either side with 30 days' written notice, per the Terms of Service. Your ad accounts stay yours.
How do I ask you to delete my information?+
Email support@sitehelpgroup.com from the address you used and we'll confirm once it's done. See our Privacy Policy.
